These Terms of Use (“Terms”) are a binding agreement between you and RNS STAR LLC (“we”, “us”, “our”) governing your use of the AI Art Generator – ArtGenie mobile application and related services (the “App”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are under the age of majority, you may use the App only with the involvement and consent of a parent or legal guardian.
2. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own lawful, non-commercial and permitted commercial creative purposes, subject to these Terms and the Apple App Store Terms of Service.
3. How the App Works
The App lets you generate images from text prompts, edit images you provide, and create AI avatars. Generations are produced using third-party artificial-intelligence providers (including OpenAI). To create your art, your prompts and any images you upload are transmitted to and processed by these providers. See our Privacy Policy for details.
4. Acceptable Use
You agree not to use the App to create, upload, or share content that:
- is unlawful, infringing, defamatory, harassing, hateful, or violent;
- is sexually explicit, depicts minors inappropriately, or is otherwise abusive;
- impersonates a real person without consent, or depicts a real individual in a misleading or harmful way;
- infringes any intellectual-property, privacy, or publicity rights;
- attempts to bypass safety filters, rate limits, payment, or security measures.
We may use automated and manual moderation and may remove content or suspend accounts that violate these Terms.
5. Your Content & AI Output
You retain ownership of the original images and prompts you provide (“Input”). Subject to your compliance with these Terms and applicable third-party terms, we do not claim ownership of the images the App generates for you (“Output”) and you may use your Output for personal and commercial purposes. You are solely responsible for your Input and your use of Output. Because AI models are probabilistic, similar Output may be generated for other users, and Output may not be unique.
6. Credits, Subscriptions & Purchases
The App offers consumable credit packs and an auto-renewable ArtGenie Pro subscription, purchased through your Apple Account via in-app purchase.
- Credits are spent per generation based on the selected quality. Purchased credits do not expire but have no cash value and are non-transferable.
- ArtGenie Pro is offered on a weekly or annual basis and may include an introductory free trial. Payment is charged to your Apple Account at confirmation of purchase.
- Subscriptions automatically renew for the same period and price unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel your subscription in your Apple Account settings. Any unused portion of a free trial is forfeited when you purchase a subscription.
7. Refunds
All purchases are processed by Apple and are subject to Apple’s refund policies. We do not directly process payments or issue refunds; please request refunds through Apple.
8. Third-Party Services
The App relies on third-party services including Apple (payments, sign-in), OpenAI (AI generation), and cloud hosting. Your use of those features is also governed by the applicable third-party terms, and we are not responsible for third-party services.
9. Disclaimers
The App and all Output are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. AI-generated content may be inaccurate, unexpected, or inappropriate; you use it at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law, RNS STAR LLC and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or USD $50, whichever is greater.
11. Termination
We may suspend or terminate your access at any time for violation of these Terms. You may stop using the App at any time. Sections that by their nature should survive termination will survive.
12. Changes
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date. Your continued use of the App after changes take effect constitutes acceptance.
